my problem is my neighbors have 3 pitbulls chained up in his backyard that are outside 24/7. They are barking constantly at all hours of the night keeping me up.

now it is 1:51am and i just called the police department to file a noise complaint because i am fed up and have to be at work in 6 hours, i have been living here for a year and it is driving me insane.

the police officer i talked on the phone to pretty much just told me there was nothing i or they could do unless the dog had come onto my property or bitten me. He didn't want to even let me file a noise complaint on it because he said there was nothing they could do if i was the only one complaining.

i know we have some people that are in the law business, whether it be a police officer or a lawyer but i am looking for advice.

aren't the owners responsible for keeping the dogs quiet, and if they aren't doing so i should be able to file a documented complaint, right?

i am so frustrated right now..

thanks ahead of time for the responces
Kyle

EDIT: i just called a different number and they dispatched an officer. I dont know if the other guy didnt have jurisdiction over that or didnt want to do the paperwork, but hopfully it will be taken care of.

Hi, Style.
Have you called your neighbors directly? That's what I used to do, even at 1:30 am...

Good luck,
Steve

yea the cop that i talked to first told me its the owners responsibility to keep them quiet, but if they were only barking they cant do anything...

i got a woman to say she was going to dispatch an officer for me, i kind of kept an eye out for about 15 min but got to tired and went to bed, i didnt notice any barking after like 4am, but i dont know if an officer actually showed up or not, they are barking away right now though...

There is usually an ordinance and I would look it up on your Community Bylaws.
I have had a friend had to defend her barking dogs and she even had to get a recording of the decibel range for defense in court.
We file with our Justice of the Peace, and it takes sometime but you can get a good size fine for not cooperating.
My dog had to wear a bark collar because my neighbor works from home and needs quite day and night.
3 dogs are a violation of our standards. We are only allowed 2.
I did not like my neighbor talking to me about my stupid dog. It causes a lot of stress for sure.
Especially @ 4 am. 4 pm was bad enough.

"and why would anyone keep 3 pitbulls unless they enjoy litigations"

If they are raised right they make great pets. We gave my grandparents one and he used to protect my little cousin all the time. He would follow her around the farm and if she tried to get too close to the road he would block her. If she kept trying to get there he would grab her by the back of her shirt and carry her back to house. He ran around loose and nobody got on the property that didn't belong and he wouldn't leave it.

Well maybe the media portrayed the breeds in a biased manner. Just too many horror stories out there i guess

hotdogs filled with benedryl tablets thrown over the fence works well....

just kidding, contact your home owners association. there may be something in the deed restrictions regarding 1) barking dogs 2) "aggressive dog breeds". if all else fails, if you have the smallest thought that the dogs may be mistreated, call the spca for an investigation.

hope it helps, good luck.
